izibuy.jp (henceforth “this website“) is operated by TOSEI CORP. (henceforth "our company"," we"," us"). TOSEI CORP. Sets out these terms and conditions (henceforth the" Terms of Service") regarding the use of the deputy purchase service (henceforth "our service") that our company provides to Members. Please read these Terms of Service precisely before using this website. By penetrating this website, you agree to be bound by the Terms of Service below. However, please do not pierce this website If you disagree with the Terms of Service below. Besides the Terms of Service, our company may, at its discretion, set out separate terms as necessary, and the said separate terms shall be integrated with the Terms of Service to form a single set of terms. We are not liable for any damages or losses caused by violating our Terms of Service.

1. Changes in the Terms of Service

1.1 We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms of Service at any time without previous announcement. Please check these terms and conditions periodically for changes.

2. Registration of Membership

2.1 Member refers to a person who wishes to use our service upon agreeing with our Terms of Service and registering on our site with the necessary information through our prescribed process upon approval by our company.

2.2 Members can register only one account per person, and registration of multiple accounts is prohibited. We reserve the right to suspend or delete the member's account(s) if it is revealed that an individual has multiple accounts. We are not responsible for any damage or loss resulting from this.

2.3 Persons are prohibited from having third parties register to become a member on their behalf. Minors must first obtain a parent’s or legal guardian's consent before becoming a website member. If a member is a minor, he will not be granted refunds or cancellations of purchases.

2.4 To become a member, individuals must enter personal information on the designation registration form on the website. Individuals are responsible for inputting all information truly, correctly, and as possible when registering for membership. In the following cases, we reserve the right to deny, suspend, or cancel membership after registration approval.

3. Management of Member ID and Password

3.1 After approval of member registration, a user ID and password (henceforth 'ID', etc.) is granted to the member. Members are responsible for keeping their user ID and password information safe and must change their passwords regularly. We do not bear responsibility for any losses or damages due to a member's negligence of this responsibility.

3.2 Members are prohibited from loaning, transferring, selling, pawning, or allowing a third party to use their user ID.

3.3 When a person has passed registration and obtained a user ID and password, we consider the user to be the Member and the account owner, and its use is the member's full responsibility. In case of unauthorized use of an ID by a third party, we will not bear responsibility for any losses. The member will be responsible for covering any damages incurred to our company or the member.

3.4 When changed, Members must immediately update any registered information on their account management page (henceforth 'account page'). We are not responsible for any losses or damages incurred due to a member's negligence or failure to update information efficiently and on time.

4. Withdrawal of membership

4.1 Members can withdraw their membership and deactivate their account through their account page, except for members with pending shipments or item delivery to our warehouse. Before a withdrawal of membership, members must confirm if they have any remaining orders that have not been completed (delivered).

4.2 If an account owner dies, the membership is considered to be withdrawn at the time of death, and the account will be deactivated..

5. Handling of personal information

5.1 TOSEI CORP. may use your personal information for the purposes as follows.
5.1.1 Management of Members;
5.1.2 Sales, as well as the Company’s product sales;
5.1.3 Sales of third-party products;
5.1.4 Billing for charges;
5.1.5 Notifications about sale campaigns, site operations, service improvements;
5.1.6 Shipment of orders;
5.1.7 Advertising of the Company’s product or third-party product or service;
5.1.8 Mail Magazine distribution;
5.1.9 Conducting questionnaires, statistical surveys, or data analysis;
5.1.10 Point and coupon rewards;
5.1.11 Contacting users for confirmation and handling inquiries;
5.1.12 Other purposes closely related to the above-listed purposes.

5.2 Our company will protect personal information and will not provide this information to third parties that do not have the purpose of use indicated without your consent. Our Company will provide the personal data in the cases as follows.
5.2.1 In the case when it is demanded by law;
5.2.2 In the case when the Member has agreed to provide personal information;
5.2.3 In the case when it is necessary to provide payment information to related parties;
5.2.4 In the case when our company or part of our service is entrusted to a third party;
5.2.5 When to ship orders (including passing custom procedures), etc;
5.2.6 In the case of a company merger, transfer of business, or other means of a succession of business to the inheriting party.

6. Suspension/Termination of Membership

6.1 In the following cases, our company may suspend or terminate an account without prior notice. Our company will not be responsible for losses or damages resulting from it.
6.1.1 If a Member does not pay charges within the designated payment period;
6.1.2 If a Member improperly or illegally uses a Member ID and password or has a third party use a Member's account improperly or unlawfully;
6.1.3 If a Member uses our service for fraudulent or illegal activity;
6.1.4 If a Member violates the Terms of Service;
6.1.5 If a Member fails to input a login password correctly after a certain number of attempts;
6.1.6 If a Member does not use an account for a period determined by our company;
6.1.7 If a Member requests a chargeback or refund through a credit card company or payment agency after the Member has successfully processed payment and placed an auction bid;

6.1.8 If our company decides a Member is ineligible for membership.

7. The service

7.1 Our service is the proxy purchasing of products or services (after these "items") from Japanese online marketplaces (from now on, "sellers") chosen by members and forwarding purchased items to members designated addresses.

7.2 We help customers with item search, advisory, billing, communication, storage, consolidation, repacking, and shipping to the end customer.

7.3 Our Company's responsibility only extends to assisting in purchasing and delivering the specified items. The Company cannot be held responsible for the contents, quality, functionality, or brand authenticity of items purchased. Any inquiries, complaints, warranty claims, defect liabilities, or other claims related to the content of the items are not accepted.

7.4 We take full responsibility for any item purchased and arrives at our warehouse by the time it leaves. If our company is responsible for damage or loss of an item, we will refund the customer up to the item’s price.

7.5 Our company cannot be held responsible for any actions sellers take, such as delivery delays, inaccurate item descriptions on their website, or the delivery of damaged or wrong items. Our team will assist in communicating with the seller to resolve any disputes, but our company cannot guarantee a positive outcome.

7.6 Our company cannot be held responsible for any potential damages or losses during the domestic or international delivery of items. If such an event does occur, it is the responsibility of the relevant transportation company to address any claims. Any delays due to customs procedures are also beyond our company's control.

7.7 Our company cannot be held responsible if customers make a mistake in purchasing an item due to incorrect translations of item descriptions from Japanese to English or any other language. If Members have any doubts regarding item descriptions, they should contact our staff for clarification.

7.8 We are not liable for unauthorized access to your account.

7.9 Members may be subject to paying customs fees by their country or region's import laws and regulations in addition to our service fees. It is the sole responsibility of the Member to pay any applicable customs fees. If Members import items that require importing approval certificates or related documentation, they must obtain all the necessary documents for their country or region. To avoid any issues with customs clearance, Members are advised to confirm this information with the local customs office in their country or region before using our service. Our company is not liable for any losses or damages due to non-compliance with regulations and customs fees. Members are responsible for any costs incurred by our company and should comply with local authorities for customs procedures and duties.

8. Purchase of Items

8.1 A contract for purchasing items between members and our company is established once a customer is notified that their auction bid has been successfully processed or payment for an order has been approved.

8.2 Nevertheless, we hold the right to refuse the purchase or international shipment of items if, during the order or warehouse delivery process, it is determined that a customer has intentionally or mistakenly ordered an item as listed in Article 11 of our Terms of Service or any equivalent item. The final decision regarding an item's eligibility for purchase or international shipment will be made by our company based on these Terms of Service and other factors, including the law and public policy.

8.3 We reserve the right to cancel orders for items listed at prices that considerably differ from the average market price, whether due to a system error or any other reason.

8.4 All items purchased through our service must be bought under our company's name and not in the name of any member. As a result, members should not contact the seller directly under any circumstances.

8.5 When purchasing items from sellers offering to print, sign, or stamp the buyer's name or other personalized text as an additional service, except in cases where the seller provides to change the name or message to a third party other than the purchaser, members acknowledge that the only choices available are to decline the optional service or to request the use of our company's or company representative's name.

8.6 Due to proxy bids placed for auctions using our service being based on a sum specified by the member, we cannot ensure that placed bids will be successful. Members are responsible for setting their maximum bid amount to a sufficient sum to increase the likelihood of a successful bid.

8.7 Members should be aware that there are situations where the seller may delete the winning bid of an auction. In such cases, the member, previously the highest bidder, must purchase the item and pay the winning bid in full. Our Customer Service team will contact the member to confirm the charge for the winning price, which will be processed through the payment method used for bidding. If our company is unable to confirm acknowledgment from the member or if the member requests a cancellation, they agree to pay whichever is more significant than 2,000 yen or 15% of the winning price.

8.8 To avoid any errors when purchasing items, members must provide us with the exact item name, item quantity, item picture, item URL, and any other necessary details related to their purchase. If a member leaves a comment with an order, our company will proceed with the order based on the information specified in the statement. Our company cannot be held responsible in cases where we were unable to purchase the correct item due to errors or ambiguous phrasing in the order information provided by the member.

8.9 Members are required to notify us before bidding on or purchasing items that fall into one or more of the following categories: items with limited availability or purchasing limit per customer, items that require us to contact the seller before bidding or purchasing, and items that need us to get or pay the seller within 24 hours of winning an auction. Members will be held liable for any losses or fees incurred by not confirming with us before placing a bid on or purchasing these items.

8.10 Members acknowledge that our company can invalidate or cancel any bids or orders under certain circumstances. We cannot be held responsible for any fees or losses incurred from the cancellation or invalidation of these purchases. If we incur any losses under these circumstances, the equivalent amount will be billed to the member for compensation.
8.10.1 In case we find out that a seller has received too many negative feedback ratings or we anticipate that we may not be able to purchase an item from a seller correctly;
8.10.2 In case a seller limits the number of transactions or sales that a single user or bidding ID can make;
8.10.3 In case a seller refuses to deal with users or bidding IDs that have had canceled transactions in the past;
8.10.4 In case an item cannot be shipped and is restricted to local pickup only;
8.10.5 In case an item cannot be shipped to our company address and is limited to certain regions;
8.10.6 In case we discover that a member has previously canceled an auction or order after winning or paying for it;
8.10.7 Other circumstances where the seller imposes extraordinary rules or restrictions on transactions;
8.10.8 In case a transaction cannot be completed due to a seller's circumstances

8.11 It is important to note that certain countries and regions do not allow shipping items containing lithium batteries or lithium-ion batteries. Therefore, members must verify the rules and regulations in their respective countries or regions before purchasing such items. Members are advised to contact our Customer Service via email for inquiries regarding this matter. Any problems or losses arising from user negligence in complying with these provisions shall be the member's sole responsibility.

8.12 Members should be aware that lithium batteries can only be shipped if installed or built into the item. To confirm this, we may need to open the item for inspection. Members who object to the item being opened should contact our Customer Service via email before placing an order. Suppose an item is returned to us because the lithium battery was not installed or built into the item. In that case, members will be responsible for all costs incurred in repacking and shipping the item again.

8.13 Detailed information about sending items containing a lithium-ion battery via international mail is listed in Clause 9, Prohibited Items—Items containing a lithium-ion battery.

8.14 Buying intangible goods, such as download codes that can be exchanged for digital items, e-tickets, e-money, and other similar items, is not permissible.

8.15 A 10% charge will be imposed on the total cost of orders that do not require physical delivery.

8.16 Our company does not facilitate the procurement of bonus items or benefits resulting from writing item reviews, nor do we purchase items that require reviews.

8.17 Members agree to transfer any points or rewards offered by any seller that can be used as part of a purchase total to our company.

8.18 If a member wishes to redeem a seller's coupon code and apply it to their order total, they must enter the coupon code into the comments section of our order form. If the coupon code is incorrectly entered, we reserve the right to proceed with the order without notifying the member.

8.19 Using our service to purchase valuables such as coins, paper currency, traveler's checks, platinum, gold or silver, gems, jewelry, etc., through Japan Post shipping is strictly prohibited. If such items are identified in a shipment, they will be returned to our warehouse, and the member will be responsible for any associated costs or fees.

8.20 We do not ship adult products overseas. Adult products are only purchased when the member's age is confirmed, and the item(s) will be sent to a Japanese address.

8.21 For Yahoo Auctions, if we cannot use a specific bidder ID repeatedly or if other members are using the same bidder ID, our system will automatically switch to a different bidder ID. Members should note that items may be shipped separately to our warehouse for auctions won on the same day from the same seller.

8.22 It is strictly forbidden to ship alcoholic beverages to an address within Japan, regardless of alcohol percentage.

8.23 Beverages with over 70% alcohol fall into the category of flammable goods, so their purchase is not permitted. Some countries may prohibit the purchase of beverages with less than 70% alcohol. Therefore, members must check with the relevant authorities before placing an order.

9. Prohibited Items

9.1 Japanese law prohibits the export of items listed in this article or items that contain parts of the listed items. Therefore, we strictly refuse the shipment of such items to any address outside of Japan. Some items listed are prohibited in Japan. If a member attempts to bid on or order a prohibited item, the transaction will be immediately canceled. We are not responsible for any fees or losses incurred due to the cancellation or invalidation of such purchases. Members will be held accountable for any losses we may incur under these circumstances.

9.2 Our company has the right to show alerts related to shipping restrictions and/or limit the purchase of items likely to fall under such regulations.

9.3 Members understand that items that have a warning message from our alert system and are successfully purchased may not be eligible for compensation upon inspection of the received item.

9.4 It is the responsibility of members to verify the regulations and guidelines concerning international shipping before placing an order or bid, as we do not guarantee our alert system's ability to detect all prohibited items.

9.5 We hold no responsibility or liability for any losses incurred if a prohibited item is purchased undetected by our alert system and is later deemed ineligible for export.

9.6 We are not responsible for confirming any country or region's rules or regulations regarding the import of items. We will not guarantee an item's eligibility for import at the destination country or region. Before placing an order or bid, members who use our service to ship items internationally are responsible for confirming rules and regulations regarding import and export in the destination country or region. We will not be held liable for any losses or damages resulting from purchasing prohibited items and will not offer cancellations, returns, or refunds in such cases. There are cases where an item ineligible for international shipping can be delivered to a Japanese address. Members who wish to ship an item to a Japanese address are responsible for ensuring that the item is eligible for domestic shipping before placing an order/bid and acknowledge that they must provide a Japanese address for the item when instructing it for shipping.

9.7 In the unlikely case that a prohibited or restricted item is instructed for shipment abroad and is discovered to be ineligible for international shipment during transport, the member will bear all costs and fees charged by the delivery company to handle the shipment according to their procedures. Further, members take full legal and financial responsibility if any incident should occur or if a third party should suffer damages as a result of shipping a prohibited item.

9.8 We may encounter an item not qualified for overseas shipping, or if a part of the item needs to be removed to make it possible to ship abroad, the member will be responsible for covering any disposal fees and other necessary expenses. If the item has already been packed, the member will also be charged an additional re-packing fee separately.

10. Items containing a lithium-ion battery

Lithium-ion batteries are commonly used in most portable electronic devices. These batteries are highly flammable, and as a result, there are various restrictions on their transportation. These restrictions apply to many devices, including cell phones, laptops, tablets, portable game consoles, e-books, digital cameras, electric toothbrushes, Bluetooth headphones, and more.
When it comes to shipping, there are restrictions:
10.1 Shipping individual batteries not integrated into devices or portable chargers, including mobile batteries, Bluetooth headphone chargers, e-cigarettes, and replacement batteries for laptops, digital cameras, and similar devices, is not permitted.
10.2 Devices with batteries exceeding 100Wh, such as electric bicycles, chainsaws, portable refrigerators, and similar devices, are prohibited from being sent.
10.3 It is not permitted to ship more than two lithium-ion batteries in a single shipment when using EMS or DHL as your courier service. When utilizing FedEx as your courier service, the maximum weight per carton allowed for shipping lithium-ion batteries is 5 kg. Please note that the batteries must be included in the unit being shipped.

11. Payment for Services

11.1 To use our service, Members need to add funds to their izibuy.jp account using a debit or credit card directly through our website using Stripe or by completing an international bank transfer.
11.2 When our members use our service to make a purchase, they must pay several fees to our company within a specified timeframe. These fees include the item price, domestic shipping from the store or seller to our warehouse, izibuy.jp usage fees, optional shipping fees, international shipping fees, and other necessary costs. It's important to note that packages with a total value of over 200,000 yen that are sent through Japan Post (EMS, International Parcel) will be subject to a 2,800 yen Export Clearance Fee.
11.3 Members may be subjected to customs duties charged in their respective country or region in addition to the fees paid to our company.
11.4 We reserve the right to withdraw funds from a member's deposit without any notice if the member fails to arrange for payment within the stipulated time limit.
11.5 Members are obligated to complete all necessary payments and procedures to have items already purchased shipped to their delivery address, even in the case of a membership suspension or deactivation, as per the terms stated in Article 6.
11.6 When multiple auctions are won on the same day from the same seller ID, and the seller agrees to combine items for domestic shipping, domestic shipping fees will be combined into a single payment.
11.7 We will bill a Member for international shipping and other related charges, if needed, once items from stores or auctions arrive at our warehouse and get packed. The payment period for international shipping and other related charges is 30 days after issuing a notification email.
11.8 If the payment for international shipping and other related charges is not settled within 30 days of being issued, we reserve the right to sell, dispose of, or discard the items without any liability.
11.9 We will not be held responsible for any losses incurred due to exchange rate fluctuation caused by the timing of billing or deposit payments made via credit card or other payment method.
11.10 Members acknowledge that our company does not charge various fees incurred during a refund, and they are not associated with us or our fees in any way.
11.11 Regardless of the reason, members agree to cover any disposal fees and other necessary expenses incurred when requesting that an item or part of an item be disposed of. If the item is already packed, an extra repacking fee applies.
11.12 If a member wishes to modify the contents of a shipment after it has been instructed, a repacking fee will be charged. It may not always be possible to modify a shipment.
11.13 Members are obligated to complete all necessary payments and procedures to have items already purchased shipped to their delivery address, even in the case of a membership suspension or deactivation, as per the terms stated in Article 6.

11.14 We keep invoices, receipts, and other payment records provided by a store or seller for record-keeping purposes, and these records will not be provided to members. Additionally, we do not accept requests for the issuance of separate receipts.

12. Packing and Shipping

12.1 Our warehouse is where all purchased items will be delivered.
12.2 Members have the option to choose from the following shipping methods: FedEx, EMS (international express mail service), and DHL.
12.3 Members must submit their shipping instructions for purchased items to a shipping group within 90 days of arriving at our warehouse.
12.4 If items are purchased from the same seller and shipped together to our warehouse, they can be divided into separate international shipments.
12.5 After the item(s) arrive at our warehouse, members must provide shipping instructions within 90 days. If our company does not receive shipping instructions before the time limit is exceeded, or if members fail to pay for international shipping and any other related charges within 30 days of receiving the notification email, we reserve the right to dispose of, sell, or discard the item(s). Our company will not be held responsible for any losses incurred under these circumstances.
12.6 If an item that has been bought cannot be shipped internationally due to it being on the list of prohibited items stated in Article 9 of our Terms of Service, we have the right to sell, dispose of, or discard it in any way we consider appropriate. Any losses or damages incurred due to such action will not be our company's responsibility.
12.7 A Non-International Delivery Fee will be applied for shipments to Japan, amounting to 15% of all charges. The charges include the order price, which covers the cost of the items and their delivery to our warehouse, an inland shipping fee, and our company's handling fee of 500 yen.
12.8 Our policy does not allow members to request specific packaging for their items or have them packed differently.
12.9 While packing an order, our staff may discover that it is damaged, incomplete, does not match the item description, or is a wrong item. We will notify the Member if this happens, but only if the Member requests a content check.
12.10 Once a shipment has been packed and is waiting to be shipped, we cannot modify the values indicated on the invoice.
12.11 Even if you request that your items be shipped together, they may still be divided into multiple shipments if the combined weight or size exceeds the limits of the chosen shipping method.
12.12 Oversized items such as car bumpers, etc., with a length of one side more than 1.5m and Length + Circumference more than 3m (some countries are restricted to one side length of 1.05m and length + circumference of 2m or 2.75m) or heavy items of more than 30 kgs can not be shipped by EMS and can only be shipped with FedEx, or DHL, or LCL.
12.13 DHL restricts the maximum length per package to 3m and the maximum width per package to 2m. FedEx Express size restrictions are length 274 cm, circumference 330 cm, and weight 68 kg; FedEx Ground restricts length 274 cm, circumference 419 cm, and weight 68 kg. FedEx may also deliver items with more than the abovementioned sizes and weights. Still, the Member needs to inquire with our staff about the possibility of shipment by FedEx before a purchase.
12.14 Oversized items, as described in article 12.1, and items valued at 300,000 yen or more, will require outsourced packing. The member will be responsible for covering the cost of packing the item(s).
12.15 Oversized items cannot be consolidated with other items.

12.16 Our company does not provide compensation for delivery services through the Money Back Guarantee system. In case of any delay in shipment, our company cannot be held liable or obligated to provide compensation.

13. Cancellations, Returns and Exchanges

Members must accept provisions for cancellations, returns, refunds, and claims to use our service. By using our service, members accept these terms.
13.1 Once bids or orders for items are placed, they cannot be canceled except with the permission or decision of the seller. However, in extraordinary cases with compelling cause that meets our screening standards and with the seller's approval, we may accept cancellations subject to the below-mentioned charges. Members should note that our company accepting a cancellation request does not guarantee that the seller will agree to cancel the order or bid.
In case of exceptional order cancellations, the following fees will apply:
1) The amount the seller charges for cancellation, including penalty fees.
2) If a seller ceases business with our company due to a cancellation, the member will bear the cost of lost profits calculated based on past performance.
13.2 Claims or requests for returns or exchanges are acceptable only within seven days of the item being delivered to our warehouse. If our company determines that the reason for the return or exchange is not due to our company or the purchasing member's fault, we will engage in discussions with the seller to arrange for an exchange or return.
Suppose the seller has indicated on the item page, seller introduction page, terms and conditions of sale, or any other page managed by them that all sales are final, and they do not accept returns or exchanges in that case. In that case, we do not have an obligation to negotiate for a return or exchange. Sellers may refuse exchanges/returns due to differences of opinion.

After purchasing an item, members agree to refrain from requesting a chargeback or refund directly through a credit card company or payment agency for reasons beyond our company's or the seller's control.

13.3 Although a seller may explicitly indicate on the item page that an item is authentic or genuine, members must understand that there is still a risk of the item being counterfeit. We will handle the item according to the "cancellations, returns, and exchanges" clause in such cases. Suppose members are required to prove the authenticity of an item. In that case, we will not be responsible for appraising or verifying the item or collecting information to aid in the appraisal or verification process. Members recognize that we will not be held accountable for any losses or damages from handling a case under this clause.

14. Prohibited activities or actions

Our service strictly prohibits the following actions or any activity that may be related to them. All members are expected to comply with these prohibitions when using our service:
14.1 Purchasing items that are prohibited by our Terms of Service;
14.2 Engaging in collusion with a seller or store to commit fraud;
14.3 Using a credit card that has been forged or falsified or using a credit card without being able to provide an authorization code when requested;
14.4 Engaging in any unlawful activity through our service;
14.5 Violating our Terms of Service or breaching public order;
14.6 Defaming or violating the rights of our company, a seller, or any third party being defamed and violated;
14.7 Contacting the seller directly with inquiries, negotiation offers, claims, or any request for refund, exchange, or repair;
14.8 Requesting a refund directly from the Member’s credit card company or payment agency after placing an order or auction bid;
14.9 Violating Japanese law, the law in your country or region of residence, or international law, or engaging in any action that may be regarded as illegal;
14.10 Failure to provide the necessary identification when purchasing items that require it;
14.11 Intentionally or without intention disrupting the business operations of our service or a seller's site;
14.12 Making demands beyond our legal liability as per the Terms of Service;
14.13 Interfering with the experience of other members of our service, the seller, or any third party using harassment or causing inconvenience;
14.14 Intentionally providing false information;
14.15 Creating and distributing malicious software or emails that can cause damage to computer systems, networks, or personal information;
14.16 Illegally accessing our site server or other computers;

14.17 Any other activity equivalent to the prohibited actions defined herein. Furthermore, members are prohibited from engaging in any actions listed above through a third party. Please note that we are not responsible or liable for any damages resulting from these actions.

15. Non-Provision of Services

If any of the following circumstances are either confirmed or deemed likely, we reserve the right to refuse to provide or complete our service for a member even after successfully purchasing items. We will not be held responsible for any losses or damages resulting from these situations:
15.1 If the item purchased is found to be included in Article 9 (Prohibited Items) or Article 10.1, 10.2, 10.3 (items containing a lithium-ion battery) of our Terms of Service or equivalent to such items;
15.2 If it is determined that obtaining an item purchased by a member is unreasonably difficult;
15.3 If an item purchased displays incorrect or significantly different price or information from the general market due to a seller mistake or system error;
15.4 If items are not delivered to our warehouse from the seller, regardless of reason;
15.5 If a member does not settle necessary payments to our service within the designated period;
15.6 If items are discarded or disposed of at customs;
15.7 If a member is unable or unwilling to receive the item(s) purchased;
15.8 If the member's delivery address is unknown or cannot be confirmed;

15.9 If a member is unresponsive to communication;

16. Insurance Disclaimer

By using our service, members acknowledge that we are a proxy service and cannot provide any guarantees in the following cases. Under the circumstances detailed below, we are not liable for any losses incurred by members:
16.1 Our company cannot guarantee the completion of an order after it has been placed.
16.2 Our company cannot guarantee that the seller will send us the exact item as described.
16.3 Our site cannot guarantee the accuracy, timeliness, or validity of the item descriptions listed by sellers. The same applies to any content or phrasing our automatic translator application uses.
16.4 Our company cannot guarantee that a purchased item can be exported from Japan or that it can be imported to the destination country or region.
16.5 Our company cannot guarantee that our services will not be delayed or stopped due to a system error, unauthorized access from an electronic attack, or error caused by a third party to avoid data loss.

16.6 Our company does not guarantee that members will not suffer loss from a computer virus or other harmful program when using the service site.

17. Suspension and Interruption of Services

We may modify or alter some or all of our services or terminate or pause our services entirely without any prior notice to carry out routine maintenance, alleviate system overload, safeguard members' personal information, or for any other reason required to provide improved service. We are not responsible for any losses or damages incurred by members due to such interruptions or suspensions.

18. Changes to and Suspension of Services

18.1 Our service may be modified or terminated without prior notice at any time at our discretion.

18.2 We cannot be held responsible for any losses suffered by members as a result of changes to fees or services or their suspension.

19. Law and Jurisdiction

19.1 Our Terms of Service and other agreements are subject to Japanese law and will be interpreted accordingly. Any interpretation based on non-Japanese law will not affect the interpretation of our agreements.
19.2 If there is a conflict or dispute regarding our Terms of Service, it will be resolved in the Toyama District Court or Toyama Small Claims Court, as they are the exclusive agreement jurisdictional courts of the first instance.
